§ 2. General provisions
-
These Terms of Service constitute terms and conditions for the provision of services by electronic means within the meaning of Article 8(1)(1) of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws 2002 No. 144, item 1204, as amended).
-
Acceptance of these Terms of Service is a prerequisite for using InterScript’s services. The Terms of Service form an integral part of the Agreement concluded between InterScript and the Client.
Submission by the Client of a demand for Services, regardless of whether it was made in electronic or written form, is tantamount to acceptance of the Terms of Service.
-
The Terms of Service define the rights and obligations of InterScript and the Client arising from the concluded Agreement.
-
By accepting the Terms of Service, the Client agrees that InterScript will execute all instructions regarding the Services and respond to questions regarding the services only if the Client uses the User’s e-mail address indicated in the Client Panel to issue the instruction or send the question, or uses the Ticket System.
-
InterScript reserves the right to amend the Terms of Service. InterScript will inform the Client by electronic means (via e-mail) of any change to the Terms of Service 14 days before the effective date of the given change. Lack of acceptance of the change by the Client is tantamount to termination of the Agreement at the end of the period for which the Client has paid the fee.
§ 3. Account registration
- Account registration is voluntary, but it is necessary to order and pay for Services in the Hosting. Registration takes place at https://spot.gg/en/register or in the Application.
- To register an account, it is necessary to have an active e-mail address and to set a password for the Client Panel.
- During registration, it is also required to confirm that the Client has read and accepted the provisions of these Terms of Service.
- During account registration, the Client may specify whether they wish to receive from the Service Provider information about InterScript’s news and promotions.
- To complete the Account registration process, the Account in the Client Panel must be activated by going to the page indicated in the message sent to the e-mail address provided during the Account registration process.
§ 4. Logging into the Client Panel
- Logging into the Client Panel takes place at https://spot.gg/en/login or in the Application.
- The Authentication process may be carried out only by the User.
- InterScript is not liable for any damage resulting from making login data (e-mail and password) available to third parties.
- The login form is properly secured with SSL encryption.
- In case of login problems, the User may at any time reset the password at https://spot.gg/en/forgot-password. The User will receive further instructions by e-mail to the address provided during the registration process.
§ 5. Wallet
- The Wallet is the Client’s internal, virtual account in the Client Panel, on which the Client’s funds may be held, in particular those originating from a refund of a previous payment.
- The Wallet cannot be topped up independently. Funds accumulated in the Wallet cannot be withdrawn to the Client’s bank account.
- If, at the time of placing an Order or extending an active Service, there are funds in the Client’s Wallet, they are automatically credited towards that Order as a separate payment transaction – in full, if they are sufficient to cover the entire amount of the Order, or in part, if the amount of the Order is higher than the available funds (the remaining part of the amount due is paid by the Client using another available payment method). Funds from the Wallet are not used for Automatic renewal (§ 10).
- The Wallet informs the User about the current balance and the history of operations on the Account, such as the purchase of Services or settlement of a refund. The Wallet is available in the Client Panel at https://spot.gg and is not available in the Application.
- The Wallet and Points (§ 6a) are independent of each other – funds from the Wallet cannot be converted into Points, and Points cannot be converted into funds in the Wallet.
- Funds in the Wallet are expressed in Polish zloty (PLN) and may be used only for Orders in PLN (§ 6(4)). Deletion of the Account in the Client Panel is not possible as long as there are funds of at least PLN 5 in the Wallet. A balance lower than PLN 5 is forfeited upon deletion of the Account, after confirmation of this by the Client during Account deletion.
§ 6. Payments
- Payment for an Order may be made with funds accumulated in the Wallet (§ 5) and via the following payment methods: fast bank transfer (Przelewy24), including BLIK, PayPal, and payment card (Visa, Mastercard and others) processed by the operator Stripe.
- For card payments, full card details (including its number and CVC code) are not provided to or stored by InterScript – they are received directly by the payment operator Stripe. If the Client saves a card, InterScript stores only the data indicated in § 10(10).
- Service prices are expressed in the currency assigned to a given Order, selected from among the currencies available in the Account Settings (in particular Polish zloty – PLN and euro – EUR). The currency is set by default automatically based on the Client’s country and may be changed manually by the Client (in the Account Settings or in the page header) before placing the Order. Changing the currency to one other than Polish zloty (PLN) is not possible as long as there are funds in the Wallet (§ 5(6)). After placing the Order, the currency assigned to it does not change.
- Available payment methods depend on the currency of the Order and are presented to the Client before paying for the Order. A payment card is available for every currency, PayPal – for currencies it supports, and Przelewy24 (including BLIK) and the Wallet – only for Orders in Polish zloty (PLN).
- Extension of a Service may also be paid for with Points, under the rules set out in § 6a.
- In the Application, payment methods are limited – Services are extended there with Points (§ 6a).
§ 6a. Points
- Points are used solely to pay for the extension of the Client’s Services – manually or as part of automatic extension (para. 9). Points are not money, electronic money or a means of payment. They are not exchangeable for money or withdrawable, cannot be transferred to another Account or used for other Orders (in particular for ordering a new Service, changing Service parameters or reviving a Service in R.I.P. status – § 9(5)). Points may be used only by the Client who is the owner of the Service.
- The Client may obtain Points:
- by purchasing in the Application a one-time Points package or a Points subscription,
- in the Referral Program (§ 6b),
- as a result of a refund for an Order paid with Points (para. 8) or compensation granted by the Service Provider (§ 18(4)).
- Points can be purchased only in the Application, via the Google Play payment system. The seller of Points to the Client is Google (Google Commerce Limited), acting as InterScript’s representative – the Client concludes the purchase agreement with Google under the Google Play terms, and the payment is received and processed by Google. InterScript does not receive the Client’s payment data. The price of the package or subscription (in the currency and with taxes set in Google Play, regardless of the currency assigned to the Account) and the number of Points the Client will receive are presented in the Application before purchase. Points are credited to the Account immediately after payment confirmation by Google.
- The Points subscription renews automatically every month until it is cancelled by the Client in Google Play. For each paid subscription period, the number of Points indicated at purchase is credited to the Account. Cancellation of the subscription takes effect from the end of the current billing period – Points already credited remain on the Account. The Points subscription and automatic extension of Services with Points (para. 9) are independent of each other. Uninstalling the Application does not cancel the subscription – the Client cancels it in Google Play. Deletion of the Account in the Client Panel cancels the subscription automatically: it will not renew after the current billing period, and a refund of the fee for that period is possible only under the Google Play rules.
- Points are digital content not supplied on a tangible medium and are delivered immediately after purchase. The right to withdraw from the Points purchase agreement, consent to immediate delivery and payment refunds are governed by the Google Play terms and refund policy – the Client submits refund requests in Google Play. This does not exclude the Client’s rights arising from non-conformity of the digital content with the contract.
- If payment for Points is refunded or cancelled (in particular by Google or by way of a chargeback), the Service Provider deducts from the Account the corresponding number of Points. The Points balance may then become negative – until it is settled, the Client cannot pay with Points.
- Extension of a Service paid with Points is an extension Order within the meaning of § 9(3). The price of the extension in Points is set separately from prices in currencies and presented to the Client before confirming the extension. The Service Provider may change prices in Points – the change does not affect already paid Subscription periods.
- In the event of withdrawal from an Order paid with Points (§ 19) or acceptance of a complaint resulting in a refund, the refund is made in Points, to the Client’s Account, under the rules set out in § 19(3).
- The Client may in the Server Panel or in the Application enable automatic extension of a Service with Points, selecting the extension period (1, 3, 6 or 12 months), and may disable it at any time. The extension takes place automatically when less than 24 hours remain until the end of the Subscription period, and if there are insufficient Points at that time – also later, as long as the Service is blocked due to the end of the Subscription period and has not entered R.I.P. status (§ 9(5)), at the price in Points applicable on the day of extension. If there are insufficient Points on the Account, the extension does not take place, and the Client is informed of this by e-mail – the rules for the end of the Subscription period (§ 9) then apply.
- Points expire in full if no operation on Points has been performed on the Account for 12 months (in particular crediting, use or refund of Points). Each such operation restarts the period. The current expiry date of Points is visible in the Client Panel, and at least 30 days before the expiry of Points the Service Provider informs the Client of this by e-mail.
- Deletion of the Account in the Client Panel is possible only when there are no Services on the Account (including blocked Services). Before deleting the Account, the Client is informed of the number of Points held and confirms that they agree to their loss – beforehand they may use them to extend their Services. Deletion of the Account at the Client’s request results in the loss of unused Points. Deletion of the Account cancels the Points subscription in Google Play (para. 4).
- If the Service Provider ceases to provide the Services or withdraws Points for reasons not attributable to the Client, they will inform the Client of this by e-mail at least 30 days in advance. For Points purchased in the Application and unused by that date, the Service Provider will refund to the Client the amount corresponding to the price the Client paid for them. Points obtained free of charge (para. 2(2) and (3)) are not refundable.
- Points credited by mistake, in particular as a result of a system error, may be deducted from the Account by the Service Provider, who will inform the Client of this.
§ 6b. Referral Program
- Each Account has an individual referral code and referral link (https://spot.gg/r/{code}), available on the Points page in the Client Panel and in the Application.
- A person who provides a referral code when registering a new Account – by entering it in the registration form or by visiting https://spot.gg from the referral link, which causes the code to be filled in automatically in the same browser session – or adds it later in the Account settings, no later than before paying in money for their first Order (hereinafter: the Referred Person), receives a one-time discount of 20% on the extension of a Service for a period of 1 month, paid in money or with Points. The discount cannot be combined with other discounts (in particular with a period discount, loyalty discount and other one-time discount) – the more favourable discount for the Referred Person is applied. Only one referral code can be assigned to an Account.
- The Client whose referral link was used (hereinafter: the Referrer) receives Points for the Referred Person’s first Order paid in money (not with Points), including for the purchase of Points in the Application. The number of Points is indicated on the Points page in the Client Panel. Points are credited 14 days after payment for the Order, provided that during this time the payment for that Order has not been refunded.
- If payment for the Referred Person’s Order is refunded after the Points have been credited, the Service Provider deducts these Points from the Referrer’s Account – the balance may become negative (§ 6a(6)).
- It is prohibited to refer oneself, create Accounts in order to obtain a reward and distribute the referral link in a manner that violates § 12 (in particular as Spam). It is not allowed to enter the referral code of a person whom the Client has referred. In the event of a violation, the Service Provider may cancel rewards pending crediting and deduct Points granted as a result of the violation.
- Points from the Referral Program are granted free of charge and are not refundable or exchangeable for money.
- The Service Provider may amend or terminate the Referral Program. The change does not apply to rewards for Orders paid before its effective date.
§ 7. Customer Service Office
- Scope of matters handled by Support:
- Problems with the operation of the Server Panel, the Application and the Spot.gg Desktop App, including reporting their errors.
- Supplementing the list of engines and modpacks.
- Payments and orders.
- Ideas and proposals for changes in the Client Panel.
- Unblocking a server that has been blocked for some reason.
- Support does not handle matters beyond the Scope of matters.
- Support does not provide assistance in configuring servers.
- Support responds to tickets submitted via the ticket system in the Client Panel within 7 business days of their receipt. Tickets are handled in the order in which they are received. The time limit for handling complaints is set out in § 18.
- Support replies to messages sent by e-mail (outside the ticket system) without a specified time limit. For matters requiring a response, the ticket system in the Client Panel should be used.
§ 7a. AI Assistant
- InterScript provides an artificial intelligence-based assistant (hereinafter: AI Assistant), available at https://spot.gg, in the Client Panel, in the Application and in the Spot.gg Desktop App. The AI Assistant operates automatically and is not Support within the meaning of § 7.
- The AI Assistant’s answers are generated automatically and may be incomplete, outdated or incorrect. They are for information purposes only and do not constitute a binding statement or obligation of InterScript, in particular as to prices, refunds or conditions for the provision of Services – the binding provisions are those of the Terms of Service and the information presented when placing an Order.
- The AI Assistant may, after prior confirmation by the Client, perform actions on their server, in particular install add-ons, change configuration files, send commands to the console and restart the server. The Client approves each such action and is responsible for the decision to perform it.
- To the extent permitted by applicable law, InterScript is not liable for damage resulting from the Client being misled by the AI Assistant or for the consequences of actions performed by the AI Assistant on the Client’s server, including loss or damage to data. Before approving changes on the server, the Client should consider making a backup (§ 9a).
§ 8. Free server activation
- A new server is started only through free activation in the Client Panel, which is also accessible via a button on the home page https://spot.gg. During activation, the Client selects the game, engine or modpack and server parameters.
- Free activation is free of charge, does not require providing payment card details and does not entail an obligation to extend.
- The active time of a server from free activation is visible during activation. It may change depending on the day and time, but cannot be shorter than 1 day (24 hours).
- Only one server from free activation that has not been extended may exist simultaneously on one Account. Another free server can be activated only after extending the previous one or after its deletion.
- If at the time of activation there are no free resources, the request is placed in a queue and the server is installed as soon as the resources become available. The Client sees their place in the queue in the Client Panel.
- Until it is extended, a server from free activation:
- is not covered by backups (§ 9a),
- does not have access to the “Subaccounts” and “Task scheduler” functions,
- may be stopped automatically when there is no longer any player on the server (after the last player logs out) – the Client may restart it in the Server Panel.
- During free activation, the Client may change the server parameters and its engine and/or modpack. Changing parameters affects the extension price – all prices are visible before confirming the change.
- Extension of a server from free activation (a paid Order) preserves its files and settings – from that moment the server is a paid Service, to which the restrictions from para. 6 do not apply.
- If a server from free activation is not extended, after the active time expires it is blocked and then deleted in accordance with § 9(5)(2).
§ 9. Duration of the agreement
- The Agreement is concluded for the duration of the Subscription period of a given Service.
- 7 days before the end of the Subscription period of a given Service, InterScript will inform the Client by e-mail of the upcoming end of the Subscription period.
- Extension of the Service’s activity is tantamount to concluding the next Service Agreement for the subsequent Subscription period.
- After the end of the Subscription period, the Service is blocked, which is equivalent to lack of access to it.
- After the end of the Subscription period and blocking of the Service for this reason, the Client may extend it while retaining the data. The data retention period depends on the type of Service:
- Paid Service (including a server from free activation that has been extended) – for 7 days from the end of the Subscription period, the server remains blocked and its data remain in place. After this time, the server enters R.I.P. status: it is removed from the machine and a record of its files is stored for up to 30 days from the end of the Subscription period. During this time, the Client may revive the Service by paying for its extension. After 30 days from the end of the Subscription period, the Service together with the data is permanently deleted without the possibility of recovery.
- Server from free activation that has not been extended – data are stored for 7 days from the end of the active time. During this time, the Client may extend the server while retaining the data. After 7 days, the server together with the data is permanently deleted without the possibility of recovery (without R.I.P. status).
- The Service Provider reserves the right to change Service prices. A change in prices does not affect already paid Subscription periods. The current price is presented to the Client each time before placing an Order, and in the case of Automatic renewal (§ 10) – with appropriate advance notice, in accordance with § 10(4) and (5).
§ 9a. Backups
- InterScript automatically performs backups of paid Services’ files once a day. Automatic backups are stored for 7 days.
- The Client may additionally create backups themselves in the Server Panel, including before updating or reinstalling the engine or modpack. Backups created by the Client are stored for 24 hours. The number of such backups and the minimum interval between them are limited – the current limits are visible in the Server Panel.
- Servers from free activation that have not been extended are not covered by backups – either automatic or created by the Client.
- Backups are not counted towards the Service’s disk limit. A backup can be restored in the Server Panel; a backup cannot be downloaded (profile files can be downloaded – § 9b(3)). Backups do not include, among others, server logs, backups created by plugins or mods, and web map files (e.g. DynMap, BlueMap).
- Backups are an additional service provided without a guarantee of completeness and continuity. InterScript makes efforts to ensure that backups are performed regularly; however, the Client is responsible for data security (§ 14(3)) and should secure important data independently. A backup created while the server is running may not fully reflect a consistent state of the files.
§ 9b. Server profiles
- A profile is a record of the server’s files (including the server’s database) together with its settings, assigned to the Account in the Client Panel. One profile may be attached to a server at a time – the Client may switch the server between their profiles, and profiles not attached to any server are stored by the Service Provider.
- The number of profiles on an Account is limited. The current limit, depending on the number of the Client’s active servers, is visible in the Client Panel.
- The Client may at any time download profile files in the Client Panel or in the Spot.gg Desktop App (§ 9c) and delete a profile that is not attached to a server. Deletion of a profile is irreversible.
- After deletion of a server (in particular after the end of the Subscription period – § 9(5)), its profile remains on the Account under the rules of para. 5.
- A profile that has not been attached to any server for 6 months may be deleted by the Service Provider. At least 14 days before deletion, the Service Provider informs the Client of this by e-mail – during this time the Client may download the profile files or attach it to a server, which interrupts the running of this period.
- Deletion of the Account in the Client Panel results in deletion of all the Client’s profiles.
- Storage of profiles is an additional service. § 9a(5) applies accordingly to profiles.
§ 9c. Spot.gg Desktop App
- The Spot.gg Desktop App is free of charge and forms part of the Services. Its use requires an Account in the Client Panel – the Client logs in with the e-mail address and password for the Client Panel (§ 4), with a two-factor login code if enabled, or with a Google account linked to the Account. Login with a Google account takes place in the Client’s web browser. The Account is created on https://spot.gg (§ 3), not in the Spot.gg Desktop App. To operate, a computer with 64-bit Windows 10 or newer and an Internet connection is required.
- The Spot.gg Desktop App enables the Client in particular to:
- search the computer’s disk for Minecraft: Java Edition game worlds saved in the folders of the Minecraft game and the CurseForge and Modrinth App programs (para. 3),
- send a selected world to the Account as a new profile (§ 9b) or in place of the files of the server to which the selected profile is attached (para. 5),
- download profile files to the computer as a folder (para. 4),
- use the AI Assistant (§ 7a).
- In order to display the list of worlds, the Spot.gg Desktop App reads only the standard folders of the Minecraft game and the CurseForge and Modrinth App programs, the folders indicated in the settings of these programs (for this purpose it reads their settings files) and information about the worlds saved in the world folders (in particular the world name, game version and last played date). The search result remains on the Client’s computer. Only the files of the world that the Client chooses to send are transferred to the Service Provider – in full, including the player data saved in it (in particular their in-game identifiers, inventory and statistics) – together with the information needed to create a profile (in particular the profile name given by the Client, game version, number and total size of files and checksums). The rules for processing personal data are set out in the Privacy Policy.
- The Spot.gg Desktop App saves downloaded profile files only at the Client’s command, in the “Spot.gg Desktop App” folder in the Windows user’s Documents folder. The path is visible before the download starts. The Spot.gg Desktop App does not overwrite or delete the Client’s existing files and folders – if a folder with the same name already exists, the new folder receives the suffix “(spot.gg)”. Updating and uninstalling the program do not delete downloaded files. Temporary files created during upload and download are deleted after completion or cancellation of the operation; an interrupted download may leave an incomplete folder, which the Client deletes themselves.
- Sending a world in place of the files of the server to which the selected profile is attached replaces all existing files of that server and profile (including mods, plugins, configuration and the server database) with the uploaded world. During the operation, the server is stopped and its engine is reinstalled, if necessary in a version matched to the world version. Before confirmation, the Client is informed of this. Before replacing the files of a paid Service’s server, InterScript automatically creates a backup that the Client may restore in the Server Panel (§ 9a); servers from free activation are not covered by it. Before sending a world, the Client should close the game – a world being saved during gameplay may be copied in an inconsistent state.
- By default, the Spot.gg Desktop App starts in the background together with Windows (icon only in the system tray) and searches for worlds at each start (para. 3). Closing the program window hides it in the system tray – the program continues to run until the Client selects “Exit” in the tray icon menu. After upload or download is completed, the program displays a system notification. The Client may at any time disable starting with the system, searching at startup and notifications in the program settings.
- The “Remember me on this computer” option is selected by default at login. When selected, the session is stored on the computer in encrypted form using the Windows system mechanism, linked to the system user account, and remains valid until logging out in the Spot.gg Desktop App, changing or resetting the Account password or deleting the Account. Without this option, the session lasts until the program stops running. Logging out ends the session also on the Service Provider’s side. On a computer used by other persons, the Client should log out after finishing work – § 4(3) and § 17(3) apply accordingly to the Spot.gg Desktop App.
- The Spot.gg Desktop App automatically checks for a new version (at startup and every few hours), downloads it in the background and installs it automatically when the program is not uploading or downloading files, or after clicking “Install and restart”. The Service Provider may cease to support an older version of the program if it stops working with the Services – the Client may then use the Services after updating the program or in the Client Panel.
- InterScript grants the Client a non-exclusive, non-transferable and free licence to use the Spot.gg Desktop App solely for the purpose of using the Services, for as long as the Client holds an Account in the Client Panel. To the extent permitted by law, it is prohibited in particular to modify, decompile and distribute the program or its modified versions and to use it in a manner that disrupts the operation of the Services. The Spot.gg Desktop App contains components made available by third parties under open-source licences – these components are subject to their respective licences attached to the program.
- The Client may at any time uninstall the Spot.gg Desktop App in the Windows settings. Uninstallation removes the program and its starting with the system. Uninstallation does not delete the Account, profiles stored by the Service Provider or files downloaded by the Client to the computer (para. 4), as well as the program settings and stored session saved in the Windows user profile – before uninstallation, the Client should log out in the Spot.gg Desktop App. The Client deletes the Account together with profiles in a separate procedure, in the Account settings in the Client Panel (https://spot.gg/user/settings) – the rules for Account deletion are set out in § 1(18) and § 9b(6). After deletion of the Account, the Spot.gg Desktop App session expires and the program logs the Client out at the next connection to the Service Provider. The Client deletes files downloaded to the computer themselves.
- The Client is responsible for the selection of files sent using the Spot.gg Desktop App (§ 12(1), § 14(1)) and for securing data on their computer. To the extent permitted by law, InterScript is not liable for loss or damage to data on the Client’s computer unless it results from the program’s operation contrary to this paragraph. Downloaded profile files may contain data of Server players (in particular in world files and the server database) – from the moment of download, the Client is responsible for securing them and using them in accordance with the law. § 13(2) applies accordingly to the Spot.gg Desktop App.
§ 9d. Server page
- In the Server Panel (Configuration -> Website), the Client may enable for their Service a free, public server page at https://spot.gg/s/{address}, where {address} is the server address set in the Server Panel. The page is disabled by default. It may be enabled, disabled and its description changed only by the Client who is the owner of the Service, when the Service is active.
- The page is available to anyone who knows its address. The Service Provider marks it as not intended for indexing by web search engines and does not include it in the sitemap.
- The page displays: the server profile name and icon (§ 9b), the description entered by the Client, the game, game version, engine and modpack, server address, server status and – if the game provides it – the number of players online, connection instructions, and when less than one month remains until the end of the Subscription period – the date until which the Service is active. The description, address and connection instructions are displayed only when the server is on. The page does not contain the Client’s Account data, server files, player list or mod list.
- The description may have up to 500 characters and basic formatting. It may not contain links or web addresses – a description with a link or vulgarities will not be saved. The profile name is automatically censored on the page.
- The Client is responsible for the profile name and icon and the description displayed on the page (§ 12(1), § 14(1)). It is prohibited to use the page to post content that is unlawful, infringes third-party rights or good morals, to advertise other services or to impersonate other persons or servers.
- Anyone may report to the Service Provider content on a server page that they consider unlawful or contrary to the Terms of Service, using the “Report content” form available on the server page (https://spot.gg/s/{address}/report), indicating the reason and justification for the report and – optionally – their name and e-mail address. The form is protected against abuse (anti-spam verification and a limit on the number of reports). A reporting person who has provided an e-mail address receives confirmation of receipt of the report and information about the decision. Reports are reviewed by a Service Provider employee. If the page content violates the Terms of Service or the law, the Service Provider may delete the description or disable the page, informing the Client of this by e-mail together with justification. The Client may appeal this decision in the ticket system in the Client Panel.
- The page ceases to be available after it is disabled by the Client and after deletion of the Service (§ 9(5)). When the Service is blocked, the page informs that the server is off. After changing the server address, the previous address redirects to the new one.
§ 10. Automatic renewal (by payment card)
- The Client may enable Automatic renewal for a given Service, consisting in automatic charging of the stored payment card with the amount due for the next Subscription period, without manually placing an extension Order.
- Automatic renewal is disabled by default. The Client saves a card in the Client Panel (Settings -> Payment card), in the Automatic renewal window in the Server Panel or by selecting to save it when paying by card for an Order. Automatic renewal is enabled separately for each Service only by the Client to whom the Service belongs, in the Server Panel at https://spot.gg (the function is not available in the Application), by selecting the Subscription period (1, 3, 6 or 12 months) and giving explicit consent to charge the card stored on the Account with an amount not exceeding the amount indicated when giving consent (hereinafter: the consent amount). The consent includes a request that each subsequent Subscription period begins directly after the previous one. InterScript confirms the consent by an e-mail containing its content and the date of the first charge.
- The Client may at any time, without giving a reason and without any consequences, disable Automatic renewal in the Server Panel. Automatic renewal of a given Service is also automatically disabled when the Client enables automatic extension with Points for it (§ 6a(9)) or when payment for the Order extending this Service is refunded (in particular after withdrawal from the agreement – para. 9). Deletion of the stored card or the Account disables Automatic renewal for all the Client’s Services. Saving another card in place of the existing one causes subsequent charges under Automatic renewal to be made to the new card. Disabling does not affect charges already made.
- The charge amount is calculated on the day of the charge based on the current Service parameters (RAM, disk), the selected Subscription period, discounts due to the Client and the prices applicable on that day (§ 9(6)). If the amount does not exceed the consent amount, the card is charged with that amount, even if it is lower than at the previous renewal. If the amount is higher than the consent amount (in particular after increasing the Service parameters, using a one-time discount or changing prices) or the Account currency has changed, InterScript does not charge the card and asks the Client for new consent – without new consent, the Service is not renewed automatically.
- At least 7 days before the charge, InterScript informs the Client by e-mail of the planned charge, its amount and date. The card is charged no earlier than 24 hours before the end of the Subscription period. If the Client enables Automatic renewal later than 8 days before the end of the Subscription period or after its end (§ 9(5)), the first charge may occur earlier – in the case of an already blocked Service, immediately after enabling; the date of the first charge is given in the consent confirmation message (para. 2). After each charge, the Client receives confirmation of the extension Order.
- Funds from the Wallet (§ 5) and Points (§ 6a) are not used for Automatic renewal. Enabling Automatic renewal by card disables automatic extension with Points for that Service (§ 6a(9)) and vice versa.
- If the card charge fails (e.g. insufficient funds, expired card, bank refusal), InterScript informs the Client of this by e-mail and may make one additional attempt after about 12 hours. If the bank requires additional confirmation of the payment by the Client, InterScript informs the Client of this and does not repeat the charge, and the Client may extend the Service manually. If the Service is not paid for by the end of the Subscription period, § 9 applies. However, Automatic renewal remains enabled: if, while the Service is blocked due to the end of the Subscription period and before entering R.I.P. status (§ 9(5)), the Client saves a new card or gives new consent (para. 4), InterScript charges the card immediately and the new Subscription period is counted from the day of the charge. Automatic renewal does not cover revival of the Service from R.I.P. status, but remains enabled after its revival. The card is not charged when the Service is blocked by InterScript under § 16(2).
- Automatic renewal is not available for cards issued in India due to local requirements regarding recurring payments. Saving such a card disables Automatic renewal for all the Client’s Services. A Client using such a card may extend the Service manually or with Points purchased in the Application.
- The right of withdrawal from the agreement set out in § 19 applies to charges under Automatic renewal. Since, at the Client’s request, the next Subscription period begins immediately, in the event of withdrawal the Client pays for the time during which the Service was provided (§ 19(3)).
- Full payment card details are stored only by the payment operator (Stripe) – InterScript has no access to them (§ 6(2)). InterScript stores only the card and Client identifiers assigned by the payment operator, the card brand, the last four digits of its number and its expiry date – to show the Client which card will be charged – and the card’s country of issue, to check whether Automatic renewal is available for it (para. 8). The last four digits of the card are also recorded in the consent confirmation (para. 2).
