§ 2. General provisions
-
These Terms of Service constitute terms and conditions for the provision of services by electronic means within the meaning of Article 8(1)(1) of the Act of 18 July 2002 on the provision of services by electronic means (Dz. U. 2002 Nr 144, poz. 1204 z późn. zm.).
-
Acceptance of these Terms of Service is a prerequisite for using InterScript services. The Terms of Service form an integral part of the Agreement concluded between InterScript and the Client.
Submission by the Client of a request for Services, regardless of whether it was made in electronic or written form, is tantamount to acceptance of the Terms of Service.
-
The Terms of Service define the rights and obligations of InterScript and the Client arising from the concluded Agreement.
-
By accepting the Terms of Service, the Client agrees that InterScript will execute any instructions regarding the Services and respond to questions regarding the services only if the Client, when issuing the instruction or sending the question, uses the User’s e-mail address indicated in the Client Panel or uses the Ticket System.
-
InterScript reserves the right to amend the Terms of Service. InterScript will inform the Client by electronic means (via e-mail) of any change to the Terms of Service 14 days before such change comes into force. Lack of acceptance of the change by the Client is tantamount to termination of the Agreement at the end of the period for which the Client has paid the fee.
§ 3. Account registration
- Account registration is voluntary, but it is necessary to order and pay for Services in the Hosting. Registration takes place at https://spot.gg/en/register.
- To register an account, it is necessary to have an active e-mail address and to set a password for the Client Panel.
- During registration, it is also required to confirm that the content of these Terms of Service has been read and to accept their conditions.
- During account registration, the Client may specify whether they wish to receive from the Service Provider information about InterScript news and promotions.
- To complete the Account registration process, the Account in the Client Panel must be activated by going to the page indicated in the message sent to the e-mail address provided during the Account registration process.
§ 4. Logging into the Client Panel
- Logging into the Client Panel takes place at https://spot.gg/en/login.
- The Authentication process may only be carried out by the User.
- InterScript is not liable for any damage resulting from making login data (e-mail and password) available to third parties.
- The login form is properly secured with SSL encryption.
- In case of login problems, the User may at any time reset the password at https://spot.gg/en/forgot-password. The User will receive the remaining instructions by e-mail at the address provided during the registration process.
§ 5. Wallet
- The Wallet is the Client’s internal, virtual account in the Client Panel, on which the Client’s funds may be held, in particular those originating from a refund of a previous payment.
- The Wallet cannot be topped up independently. Funds accumulated in the Wallet cannot be withdrawn to the Client’s bank account.
- If, at the time of placing an Order or extending an active Service, there are funds in the Client’s Wallet, they are automatically credited towards that Order as a separate payment transaction – in full, if they are sufficient to cover the entire amount of the Order, or in part, if the amount of the Order is higher than the available funds (the Client pays the remaining part of the amount due using another available payment method).
- The Wallet informs the User about the current balance of funds and the history of operations on the Account, such as the purchase of Services or settlement of a refund.
- The Wallet and Points (§ 6a) are independent of each other – funds from the Wallet cannot be converted into Points, and Points cannot be converted into funds in the Wallet.
§ 6. Payments
- Payment for an Order may be made with funds accumulated in the Wallet (§ 5) and via the following payment methods: fast bank transfer (Przelewy24), including BLIK, PayPal, and payment card (Visa, Mastercard and others) processed by the operator Stripe.
- When paying by card, payment card data is never transmitted to or stored by InterScript – it is received directly by the payment operator.
- Service prices are expressed in Polish zloty (PLN) or in euro (EUR), depending on the currency assigned to a given Order. The currency is by default set automatically based on the Client’s country and may be manually changed by the Client (in Account Settings or in the page header) before placing the Order. After placing the Order, the currency assigned to it does not change.
- For Orders in a currency other than Polish zloty (PLN), the only available payment method is payment card – Przelewy24, PayPal and the Wallet are available exclusively for Orders in Polish zloty (PLN).
- The extension of a Service may also be paid for with Points, under the rules set out in § 6a.
§ 6a. Points
- Points are used solely to pay for the extension of the Client’s Services – manually or as part of automatic extension (para. 9). Points are not money, electronic money or a means of payment. They are not exchangeable for money or subject to withdrawal, they cannot be transferred to another Account or used for other Orders (in particular for changing Service parameters).
- The Client may obtain Points:
- by purchasing in the Application a one-time Points package or a Points subscription,
- in the Referral Program (§ 6b),
- as a result of a refund for an Order paid with Points (para. 8) or compensation granted by the Service Provider (§ 18 para. 4).
- Points can be purchased only in the Application. Payment is received and processed by Google under the Google Play payment system, under the terms of Google Play – InterScript does not receive the Client’s payment data. The price of the package or subscription and the number of Points the Client will receive are presented in the Application before purchase. Points are credited to the Account immediately after payment is confirmed by Google.
- The Points subscription renews automatically every month until it is cancelled by the Client in Google Play. For each paid subscription period, the number of Points indicated at purchase is credited to the Account. Cancellation of the subscription takes effect from the end of the current billing period – Points already credited remain on the Account. The Points subscription and automatic extension of Services with Points (para. 9) are independent of each other.
- Points are digital content not supplied on a tangible medium and are delivered immediately after purchase. Before purchase, the Client who is a consumer gives explicit consent to the immediate crediting of Points and acknowledges that upon their crediting they lose the right to withdraw from the Points purchase agreement (Article 38(1)(13) of the Act of 30 May 2014 on consumer rights). The Client receives confirmation of the purchase together with this information by e-mail. This does not exclude the possibility of submitting a refund request directly to Google, in accordance with Google Play rules, nor the Client’s rights in respect of non-conformity of the digital content with the contract.
- If payment for Points is refunded or cancelled (in particular by Google or by way of a chargeback), the Service Provider deducts from the Account the corresponding number of Points. The Points balance may then become negative – until it is settled, the Client cannot pay with Points.
- Extension of a Service paid with Points is an extension Order within the meaning of § 9 para. 3. The extension price in Points is set separately from prices in currencies and presented to the Client before confirming the extension. The Service Provider may change prices in Points – the change does not affect already paid Subscription periods.
- In the event of withdrawal from an Order paid with Points (§ 19) or acceptance of a complaint resulting in a refund, the refund is made in Points, to the Client’s Account, under the rules set out in § 19 para. 3.
- In the Server Panel, the Client may enable automatic extension of the Service with Points, selecting the extension period, and may disable it at any time. The extension takes place automatically when less than 24 hours remain until the end of the Subscription period (or after its end, during the period of data storage for a blocked Service – § 9 para. 5), at the price in Points applicable on that day. If there are not enough Points on the Account, the extension does not take place and the Client is informed of this by e-mail – the rules for the end of the Subscription period (§ 9) then apply.
- Points expire in full if no operation on Points has been performed on the Account for 12 months (in particular crediting, use or refund of Points). Each such operation restarts this period. The current Points expiry date is visible in the Client Panel, and at least 30 days before the Points expire the Service Provider informs the Client of this by e-mail.
- Before deleting the Account in the Client Panel, the Client is informed of the number of Points held and may use them to extend their Services. Deletion of the Account at the Client’s request results in the loss of unused Points.
- If the Service Provider ceases to provide the Services or withdraws Points for reasons not attributable to the Client, they will inform the Client of this by e-mail at least 30 days in advance. For Points purchased in the Application and not used by that date, the Service Provider will refund to the Client the amount corresponding to the price the Client paid for them. Points obtained free of charge (para. 2 points 2 and 3) are not subject to refund.
- Points credited by mistake, in particular as a result of a system error, may be deducted from the Account by the Service Provider, who will inform the Client of this.
§ 6b. Referral Program
- Each Account has an individual referral link, available in the Client Panel on the Points page.
- A person who registers a new Account within 30 days of visiting https://spot.gg from a referral link (hereinafter: the Referred Person) receives a one-time discount of 20% on the first extension of a Service for a period of 1 month. The discount cannot be combined with other discounts – the more favourable discount for the Referred Person is applied.
- The Client whose referral link was used (hereinafter: the Referrer) receives Points for the Referred Person’s first Order paid with money (not with Points). The number of Points is indicated on the Points page in the Client Panel. Points are credited 14 days after payment for the Order, provided that during this time the payment for that Order has not been refunded.
- If payment for the Referred Person’s Order is refunded after the Points have been credited, the Service Provider deducts these Points from the Referrer’s Account – the balance may become negative (§ 6a para. 6).
- It is prohibited to refer oneself, to create Accounts in order to obtain a reward, and to distribute the referral link in a manner that violates § 12 (in particular as Spam). In the event of a violation, the Service Provider may cancel rewards pending crediting and deduct Points granted as a result of the violation.
- Points from the Referral Program are granted free of charge and are not subject to refund or exchange for money.
- The Service Provider may amend or terminate the Referral Program. The amendment does not apply to rewards for Orders paid before it comes into force.
§ 7. Customer Service Office
- The scope of matters handled by Support:
- Problems with the operation of the Server Panel, including reporting its errors.
- Supplementing the list of engines and packs.
- Payments and orders.
- Ideas and proposals for changes in the Client Panel.
- Unblocking a server that has been blocked for some reason.
- Support does not handle matters beyond the Scope of matters.
- Support does not provide assistance in configuring servers.
- Support responds to tickets submitted via the ticket system in the Client Panel within 7 business days of their receipt. Tickets are handled in the order in which they are received. The time limit for handling complaints is set out in § 18.
- Support replies to messages sent by e-mail (outside the ticket system) without a fixed time limit. For matters requiring a response, the ticket system in the Client Panel should be used.
§ 7a. AI Assistant
- InterScript provides an artificial-intelligence-based assistant (hereinafter: the AI Assistant), available on https://spot.gg and in the Client Panel. The AI Assistant operates automatically and is not Support within the meaning of § 7.
- The AI Assistant’s answers are generated automatically and may be incomplete, outdated or incorrect. They are for information purposes only and do not constitute a binding statement or obligation of InterScript, in particular with regard to prices, refunds or conditions for the provision of Services – the binding provisions are those of the Terms of Service and the information presented when placing an Order.
- The AI Assistant may, after prior confirmation by the Client, perform actions on their server, in particular install add-ons, change configuration files, send commands to the console and restart the server. The Client approves each such action and is responsible for the decision to perform it.
- To the extent permitted by applicable law, InterScript is not liable for damage resulting from the Client being misled by the AI Assistant or for the consequences of actions performed by the AI Assistant on the Client’s server, including loss or damage to data. Before approving changes on the server, the Client should consider making a backup (§ 9a).
§ 8. Free server activation
- A new server is launched exclusively through free activation in the Client Panel, which is also accessible via a button on the home page https://spot.gg. During activation, the Client selects the game, engine or mod pack and server parameters.
- Free activation is free of charge, does not require providing payment card details and does not entail an obligation to extend.
- The server activity time from free activation is visible during activation. It may change depending on the day and time, but cannot be shorter than 1 day (24 hours).
- Only one server from free activation that has not been extended may exist simultaneously on one Account. Another free server can be activated only after the previous one has been extended or after it has been deleted.
- If at the time of activation there are no free resources, the request is placed in a queue and the server is installed as soon as resources become available. The Client sees their place in the queue in the Client Panel.
- Until it is extended, a server from free activation:
- is not covered by backups (§ 9a),
- does not have access to the “Subaccounts” and “Task scheduler” functions,
- may be automatically stopped when there is no longer any player on the server (after the last player logs out) – the Client may restart it in the Server Panel.
- During free activation, the Client may change the server parameters and its engine and/or pack. Changing parameters affects the extension price – all prices are visible before confirming the change.
- Extending a server from free activation (a paid Order) preserves its files and settings – from that moment the server is a paid Service, to which the restrictions in para. 6 do not apply.
- If a server from free activation is not extended, after the activity time expires it is blocked and then deleted in accordance with § 9 para. 5 point 2.
§ 9. Duration of the agreement
- The Agreement is concluded for the duration of the Subscription period of a given Service.
- 7 days before the end of the Subscription period of a given Service, InterScript will inform the Client by e-mail of the upcoming expiry of the Subscription period.
- Extending the activity of a Service is tantamount to concluding the next Service Provision Agreement for the next Subscription period.
- After the end of the Subscription period, the Service is blocked, which is equivalent to lack of access to it.
- After the end of the Subscription period and blocking of the Service for this reason, the Client may extend it with data retention. The data retention time depends on the type of Service:
- Paid Service (including a server from free activation that has been extended) – for 7 days from the end of the Subscription period, the server remains blocked and its data remains in place. After this time, the server enters the R.I.P. state: it is removed from the machine and a record of its files is stored for up to 30 days from the end of the Subscription period. During this time, the Client may resurrect the Service by paying for its extension. After 30 days from the end of the Subscription period, the Service together with the data is permanently deleted without the possibility of recovery.
- Server from free activation that has not been extended – data is stored for 7 days from the end of the activity time. During this time, the Client may extend the server with data retention. After 7 days, the server together with the data is permanently deleted without the possibility of recovery (without the R.I.P. state).
- The Service Provider reserves the right to change Service prices. A price change does not affect already paid Subscription periods. The current price is presented to the Client each time before placing an Order, and in the case of Automatic renewal (§ 10) – with appropriate advance notice, in accordance with § 10 para. 4.
§ 9a. Backups
- InterScript automatically performs backups of paid Services’ files once a day. Automatic backups are stored for 7 days.
- The Client may additionally create backups themselves in the Server Panel, including before updating or reinstalling the engine or mod pack. Backups created by the Client are stored for 24 hours. The number of such backups and the minimum interval between them are limited – the current limits are visible in the Server Panel.
- Servers from free activation that have not been extended are not covered by backups – either automatic or created by the Client.
- Backups are not counted towards the Service’s disk limit. A backup can be restored in the Server Panel; a backup cannot be downloaded (profile files can be downloaded – § 9b para. 3). Backups do not include, among other things, server logs, backups created by plugins or mods, and web map files (e.g. DynMap, BlueMap).
- Backups are an additional service provided without a guarantee of completeness and continuity. InterScript makes efforts to ensure that backups are performed regularly; however, the Client is responsible for data security (§ 14 para. 3) and should independently secure important data. A backup created while the server is running may not fully reflect a consistent state of the files.
§ 9b. Server profiles
- A profile is a record of the server’s files (including the server database) together with its settings, assigned to the Account in the Client Panel. One profile can be attached to a server at a time – the Client may switch the server between their profiles, and profiles not attached to any server are stored by the Service Provider.
- The number of profiles on an Account is limited. The current limit, depending on the number of the Client’s active servers, is visible in the Client Panel.
- The Client may at any time download profile files in the Client Panel and delete a profile that is not attached to a server. Deletion of a profile is irreversible.
- After a server is deleted (in particular after the end of the Subscription period – § 9 para. 5), its profile remains on the Account under the rules of para. 5.
- A profile that has not been attached to any server for 6 months may be deleted by the Service Provider. At least 14 days before deletion, the Service Provider informs the Client of this by e-mail – during this time the Client may download the profile files or attach it to a server, which interrupts the running of this period.
- Deletion of the Account in the Client Panel results in deletion of all the Client’s profiles.
- Storage of profiles is an additional service. § 9a para. 5 applies accordingly to profiles.
§ 10. Automatic renewal (by payment card)
- A Client paying for a Service by payment card may activate Automatic renewal – consisting in automatically charging the stored card with the amount due for the next Subscription period, without the need to manually place an extension Order.
- Automatic renewal is disabled by default. Its activation requires the Client’s explicit, voluntary consent expressed in the Client Panel (Settings -> Payment methods). The Client may at any time, without giving a reason and without any consequences, disable Automatic renewal in the same place. Disabling does not affect charges already made.
- The amount of each charge under Automatic renewal is calculated on the day of the charge, based on the current parameters of the Service (RAM, disk) and the prices applicable on that day (§ 9 para. 6) – it may differ from the amount charged at the previous renewal, in particular in the event of a change in the Service parameters by the Client or a change in prices by the Service Provider.
- The planned amount of the next charge under Automatic renewal is always visible in the reminder referred to in § 9 para. 2.
- If the card charge fails (e.g. insufficient funds, expired card, bank refusal), the Service Provider may make further attempts to charge within a short period after the failed attempt. If, despite this, the charge does not succeed by the end of the Subscription period, the rules for the end of the Subscription period set out in § 9 apply.
- The right to withdraw from the agreement set out in § 19 applies to charges made under Automatic renewal on the same terms as to other Orders.
- Payment card data used for Automatic renewal is stored solely by the payment operator – InterScript does not have access to it and does not store it (§ 6 para. 2).
§ 11. Obligations of InterScript
- InterScript is obliged to ensure full availability of the Services and to provide the Services with due diligence, in accordance with the provisions of the Agreement and the Terms of Service.
- InterScript reserves the right to carry out technical breaks at any time if the situation so requires.
- InterScript is obliged to inform the Client of each change to the Terms of Service.
§ 12. Obligations of the Client
- The Client is obliged to use the Services provided by InterScript in a manner that does not infringe the rights of third parties, in particular copyright and related rights and personal rights, to comply with legal regulations, to respect the principles of social coexistence and good morals, the provisions of the Agreement and the Terms of Service, to refrain from using the Services to post, make available and disseminate unlawful content that infringes the rights and personal rights of others, good morals and the principles of social coexistence, as well as from sending Spam.
- The Client is obliged not to undertake actions that may cause damage to other Clients or Users. The Client is also obliged not to place on the InterScript server files, scripts or programs that may cause improper functioning of the server, connections or other persons’ accounts.
§ 13. Liability of InterScript
- InterScript is liable for non-performance or improper performance of the Services entrusted to it, unless this occurred for reasons for which InterScript is not responsible.
- InterScript is not liable for non-performance or improper performance of the Services if it was the result of circumstances, in particular such as:
- Lack of continuity in the provision of Services caused by actions or omissions of entities other than InterScript.
- Hardware or software failure that InterScript could not prevent and over the occurrence of which it had no influence.
- Force majeure.
- Improper use of the Services by the User:
- Unintentional installation of plugins/mods from untrusted sources and installation of plugins/mods compatible with the software that InterScript places in the server management panel.
- Incompetent configuration of the server. Making many configuration errors due to the User’s lack of knowledge necessary for proper operation of the Service.
- Violation by the Client of the provisions of the Agreement, the Terms of Service, or legal regulations.
- Gaining access to the Client’s Account by unauthorised persons.
- Other irregularities not foreseen by the Terms of Service generated by the User.
- Operation of a computer virus.
- Information, programs, applications, files downloaded by the Client from the Internet.
- A DDoS attack, which is an attack on a computer system or network service in order to prevent operation by occupying all free resources, carried out simultaneously from many computers.
- InterScript bears no liability for content placed by the Client on the server made available to them.
- InterScript is not liable for the Client’s lost profits, and its possible liability for non-performance or improper performance of the Agreement is limited to the amount of the Subscription Fee paid by the Client.
- InterScript is not liable for the operation of software of which it is not the author. This applies to server engines, plugins, mods and other types of software.
§ 14. Liability of the Client
- The Client bears full liability for the content located on the part of the server made available to them.
- The Client bears full liability for the manner in which the User uses the Services, including for violations of the provisions of the Agreement, the Terms of Service, generally applicable legal regulations, the principles of social coexistence and good morals committed by the User, as well as for sending Spam. If InterScript becomes aware of a violation committed by the User, the Client undertakes to cooperate in combating the User’s unlawful activity, including providing the User’s data enabling their identification.
- The Client bears sole and unlimited liability for data stored on the InterScript server.
- InterScript may seek compensation for damage suffered in connection with improper use of the Services by the Client, violation of the provisions of the Agreement, the Terms of Service, generally applicable legal regulations, the principles of social coexistence and good morals committed by the Client or the User.
§ 15. Rights of the Client
- The Client has the right to fully use the ordered Services, however in a manner that does not violate legal regulations, the provisions of the Agreement, the Terms of Service, the rights of other persons, good morals, or the principles of social coexistence.
- The Client has the right to grant another entity (User) authorisation to use the InterScript Services ordered by the Client to the extent indicated in the authorisation; however, the Client bears full liability for any damage resulting from granting access.
- The Client has the right to lodge complaints regarding the Services provided by InterScript.
§ 16. Restrictions
- The Client may not use the Services provided by InterScript to post, make available and disseminate unlawful content that infringes the rights and personal rights of others, good morals and the principles of social coexistence, as well as to send Spam. The Client may not make available for a fee the resources that have been allocated to them by InterScript.
- If InterScript becomes aware that the Client has committed a violation of para. 1 of this section, InterScript is entitled to block the Services provided to the Client, terminate the Agreement with immediate effect and notify the relevant authorities of the violation of law committed by the Client.
- In special cases, if the provision of Services to the Client causes excessive load on the InterScript server and, consequently, deterioration of the quality of Services provided to other Clients, InterScript has the right to block the Client’s Services, of which the Client is notified in the Client Panel.
- In the event of termination of the Agreement for the reasons referred to in para. 2, the Service Provider may set off compensation for damage caused by the violation (§ 14 para. 4) against the amount due to the Client for the unused Subscription period and against the value of unused Points purchased in the Application (§ 6a).
§ 17. Security
- InterScript will adequately secure the data of Clients and Users.
- InterScript will adequately secure the User’s connections to the server.
- The Client is obliged to keep the login data to the Client Panel confidential and not to disseminate or make them available to third parties.
§ 18. Complaints

- All complaints are handled via the ticket system in the Client Panel.
- The Service Provider will consider the complaint within 14 calendar days from the date of its receipt. The Client will be informed of the decision in the form of a reply in the ticket system in the Client Panel and as a notification by e-mail.
- If the complaint is accepted, the Service Provider will take appropriate action, including removal of irregularities, extension of the service validity, granting compensation or another way of remedying the damage – as appropriate to the nature of the notification.
§ 19. Withdrawal from the agreement
- A consumer who has concluded a distance agreement has the right to withdraw from it without giving any reason within 14 days from the date of conclusion of the agreement, in accordance with the Act of 30 May 2014 on consumer rights.
- To exercise the right to withdraw from the agreement, the consumer submits to the Service Provider a statement of withdrawal – in particular via the ticket system in the Client Panel or by e-mail to [email protected]. The consumer may use the model withdrawal form constituting Appendix No. 1 to the Terms of Service, but this is not obligatory. To meet the deadline, it is sufficient to send the statement before its expiry.
- In the event of withdrawal from the agreement, the Service Provider will refund to the consumer the payments received, reduced by the time of service activity already used, no later than 14 days from the date of receipt of the notice of withdrawal from the agreement.
- The refund is made using the same payment method as that used by the consumer – for an Order paid with Points, the refund is made in Points (§ 6a para. 8).
